Custom Web Solutions (CWS) Software - Simple License Agreement
The intention of this license agreement is to protect CWS and it’s customers rights regarding use of CWS software (PhatCMS and PhatCart). We offer a limited license, with the following conditions:
- The Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The Software is licensed, not sold. Any rights not explicitly granted under this Agreement are hereby reserved.
- CWS Software is licensed perpetually to the customer exclusively for their own use on a single web site. Additional licenses must be obtained for any additional websites, these are available at a discounted rate to existing customers.
- You may make changes to the source code to add functions or to change layout, but only on your own installation. You may not build and distribute an application based on the code or portions of the code of any CWS Software covered by this license.
- CWS places no limits on users or data stored in or by our software. The only size limitations for users or data stored in our software are determined by your hardware and hosting (software & services) environment.
- Updates with bug fixes are provided FREE. Upgrades that represent a major version change and plugins not included with your version need to be purchased at additional cost.
- Custom functionality which may be built into your CWS Software is not licensed but rather sold to the customer. CWS retains copyright in the original work, and the customer has the rights to use these components however they choose. CWS has a policy of negotiating any CWS use of custom developed components internally or for other customers with the original customer who funded the work.
- CWS software is sold and licensed 'as is'. All warranties, either expressed or implied are disclaimed as to the software and its quality, performance of fitness for any particular purpose. You, the consumer, bear the entire risk relating to the quality and performance of the software. In no event will CWS be liable for direct, indirect, incidental or consequential damages resulting from any defect in the software. If the software proves to have defects, you and not CWS, assume the cost of any necessary service or repair.
